ANNUAL NOTICE OF RIGHT TO ELECT OR REVOKE FEDERAL INCOME TAX WITHHOLDING

LACERS is required to inform you that your periodic benefit payments from LACERS may be subject to Federal Income Tax withholding unless you elect not to withhold. If your benefit becomes effective in 2025, and a completed Form W-4P is not on file with LACERS, your withholding will be calculated as if your filing status is Single with no adjustments. For benefits that began before 2025, your current withholding remains in effect unless you submit a new Form W-4P.

Federal Law allows you to change or revoke the amount withheld from your monthly payments at any time. This notice is to comply with the annual Federal notice requirement.

  1. IF YOU DO NOT WISH TO MAKE CHANGES TO YOUR CURRENT WITHHOLDING:
  • NO ACTION IS REQUIRED; AND
  • YOUR CURRENT WITHHOLDING REMAINS IN EFFECT.
  1. If you choose to make changes or revoke your current election:
  • You must submit a new Federal Withholding Form W-4P. The form is available at lacers.org/forms. You may also contact LACERS at (800) 779-8328 / RTT (888) 349-3996 and request the form be mailed to you.
  • Your completed form can be returned to LACERS via:

GREAT NEWS! THE SOCIAL SECURITY FAIRNESS ACT IS NOW IN EFFECT

On January 5th, the Social Security Fairness Act was signed into law. While this law does not affect LACERS benefits, it may result in increased Social Security benefits for some LACERS Members.

The Act repeals two federal provisions, the Windfall Elimination Provision (WEP) and the Government Pension Offset (GPO) which reduced Social Security payments for many public sector retirees and survivors who received pensions from a public retirement system not requiring Social Security contributions. With the repeal, these individuals will no longer face such reductions in Social Security benefits.

The Social Security Fairness Act applies to benefits payable from January 2024 onward. For more information, contact the Social Security Administration at (866) 964-0991 or visit SSA.gov.
